Staff Correspondent:The High Court on Monday has issued a rule asking the authorities concerned to explain why they should not be directed to formulate a law under Article 118 of the Constitution for constituting the Election Commission.
On Monday noon, the bench of Justices Moyeenul Islam Choudhury and Justice JBM Hassan Hassan came up with the rule following a writ petition filed by SC lawyer Eunus Ali Akond seeking necessary order on the authorities to formulate a law under the constitution for appointing the chief election commissioner and other election commissioners.
Cabinet secretary, law secretary, and the Election Commission have been asked to come up with explanations by four weeks.
However, the High Court did not issue any order on another writ petition filed by the same lawyer with the High Court challenging the legality of the committee formed to recommend names for the next Election Commission members.
